1. Promoter of this sweepstakes is St.Vincent Hospital and Health Care Center, Inc. (“St.Vincent”) with an address of 2001 West 86th Street, Indianapolis, Indiana 46260 and the Sponsors are St.Vincent and Pacers Basketball Corporation d/b/a Indiana Pacers, Pacers Sports and Entertainment, Conseco Fieldhouse and Home Court (collectively sometimes referred to herein as “Pacers”) with an address of 125 South Pennsylvania Street, Indianapolis, Indiana 46204. Sweepstakes is open to legal residents of Indiana 18 years of age or older who have a child between the ages of eight (8) and twelve (12) years as of the time of entry. Employees and immediate families (spouses, parents, siblings and children) of St.Vincent Hospital and Health Care Center, Inc., Pacers Basketball Corporation d/b/a Indiana Pacers, Pacers Sports and Entertainment, Conseco Fieldhouse and Home Court, the National Basketball Association and its Member Teams, NBA Properties, Inc., and their respective parents, subsidiaries, affiliates, directors, shareholders, officers, governors, employees, successors, assigns and agents are not eligible to enter. By participating, entrants acknowledge compliance with these Official Rules, including all eligibility requirements.
2. No purchase necessary. To enter, go to http://powerpackkid.stvincent.org. Incomplete entries are void. Parents or legal guardians may only enter once per child. Sweepstakes begins August 27, 2008 and ends April 8, 2009. Final date for entry is April 8, 2009. All entries received after April 8, 2009 are void.
3. For twenty-seven (27) Indiana Pacers home games during the 2008-2009 regular season, one (1) lucky winner will be selected by a random drawing to have their child be the St.Vincent Power Pack Kid. A list of applicable games is included at the end of these Official Rules. An authorized St.Vincent or Pacers representative, whose decisions are final, will select winners through random drawings. The drawings will be conducted seven (7) days prior to each of the applicable Indiana Pacers home games during the 2008-2009 regular season. All entries are subject to verification at the sole discretion of St.Vincent. All entries will become property of St.Vincent and will not be acknowledged or returned. Two (2) attempts will be made to notify the winner by mail, email or phone at least ninety-six (96) hours in advance of the applicable game by an employee of Pacers. In the event the winner cannot be contacted or declines the Prize or is otherwise ineligible, another winner may be chosen at random from the eligible entries received. Any entries that are illegible, tampered with, or are obtained other than through authorized channels, are automatically void. Only those entries received prior to a drawing will be eligible for that particular drawing. Non-winning entries from previous drawings will be rolled-over into the next subsequent drawing. Neither St.Vincent nor Pacers are responsible for incomplete, inaccurate, lost, stolen, or mutilated entries.
4. Each winner will receive: four (4) tickets to the applicable Indiana Pacers home game ($220 value); a parking pass in the Virginia Street parking garage for the applicable Indiana Pacers home game ($8 value); one (1) St.Vincent Power Pack Kid T-shirt ($10 value) for the selected child; and recognition of the St.Vincent Power Pack Kid during the applicable Indiana Pacers home game and the selected child will participate on-court at the applicable Indiana Pacers home game with the Power Pack (no market value) (collectively, the “Prize”).
5. Approximate Retail Value of the Prize is $238.00. Prize not redeemable for cash. No element of the Prize will be replaced if lost or stolen and is the sole responsibility of each winner. No assignment, substitution, cash equivalent or transfer of Prize to any other person, including relatives or friends, is permitted, except by the Indiana Pacers or St.Vincent, who reserve the right to substitute a Prize of equal or greater value.
6. Winner is solely responsible for all applicable federal, state and local taxes and any expenses (including but not limited to travel to and from the game) associated with the Prize, unless otherwise indicated.
7. Chances of winning are dependent upon the total number of eligible entries received prior to the date of the particular drawing.
8. By entering, entrants and/or their children agree to follow the Official Rules and forever release, discharge, and waive any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that entrant and/or their children may have or that may arise against St.Vincent Hospital and Health Care Center, Inc., Pacers Basketball Corporation d/b/a Pacers Sports & Entertainment, Indiana Pacers, Conseco Fieldhouse and Home Court, and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, partners, subsidiaries, affiliates, directors, officers, governors, owners, shareholders, employees, successors, assigns and agents (“collectively, the “Released Parties”), with respect to or arising out of either (i) entrant’s and/or their child’s participation; or (ii) the receipt or use of the prizes awarded in the sweepstakes. By entering, entrants and/or their children further agree to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and/or expenses (including but not limited to legal fees) they may incur as a result of claims made against them in connection with either (i) entrant’s and or their child’s participation; or (ii) the receipt or use of the prizes awarded in the sweepstakes. All federal, state, and local laws and regulations apply. All rights reserved.
9. In consideration for being awarded the Prize, each winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of said winner’s and/or their child’s name and/or likeness in any and all advertising, promotions and other publicity conducted by St.Vincent, Pacers Basketball Corporation d/b/a Indiana Pacers, Pacers Sports and Entertainment, Conseco Fieldhouse and Home Court and/or the National Basketball Association and it’s Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, successors, assigns and agents, except where prohibited.
10. Each winner may be required to sign a Release of Liability (which includes a parental consent form and publicity release) in order to collect the Prize or an alternate winner may be selected. Noncompliance with this or any requirement in the Official Rules may result in disqualification and forfeiture of the Prize and the random selection of an alternate winner.
11. A list of winners can be obtained by sending a self-addressed stamped envelope by July 1, 2009 to “St.Vincent Power Pack Kid Winners 2008-09”, 2001 West 86th Street, Indianapolis, Indiana 46260.
12. Sweepstakes void where prohibited.
